Letter To Editor: Constable Threatens County With Lawsuit

To The Editor:
​Advice of the county attorney was that magistrates could vote for individual constables to have or not have emergency equipment.

The judge then says that they need to vote on ALL constables at once, not individually.

This spiel that was first given, was just a sham  to divert what his true agenda is. Stomp down Constables.

Well, since I have been discriminated against by fiscal court's use of the pretense of what another Constable MIGHT do, then I have chosen to seek out an attorney and file suit against fiscal court for their actions which have made it difficult if not impossible for me to do the job to which I was elected.

Simply put, one can NOT deny something based on what someone else may or may not do.

By stating in open fiscal court about the willingness of another constable to sue, if I were granted lights and he not, then this decision to deny my rights, was based on that.

It is another form of discrimination, based on a perceived threat from another constable. As I stated, I can not and WILL NOT be held accountable for what another individual may or may not do.

Fiscal court will be held accountable in a court of law.

After researching the issues at hand, I believe I have found a solution to the constable issue.
They should be eliminated in the county.
Reasoning for this is simple. If one who is vetted to a high standard, yet is judged the same as the least, then the office is not worth having.
I submit that we should ask county magistrates to vote to increase constable bods on ANY elected constables (ANY and ALL) to a sum of $2,000,000. No insurance company in their right mind will write such a bond for a constable position. Then, after a period of 7 days, per law, when the constable can not produce the required bond, he forfeits his office. This will eliminate the good with the less desirable candidates, but will wipe the slate clean, and you have no more constables. Speaking for myself, I feel if I am to be judged and penalized with the backing and support that I had, then this job is not worth continuing to do.
I can not and will not resign, but, the two million dollar bond would solve the problems in ALL districts, legally and without issue (or lawsuits from any district) .
I would support such a move 100%. Sometimes one must sacrifice for the greater good.
Problem solved !
